Wire service photo of Emily Spreckels (later Tremaine) reportedly wearing one million in diamonds and stealing the press at the Beaux Arts Ball in New York, signalling her move up the society ladder. (Pittsburgh Post-Gazette, 30 January 1940, p. 22.) Understood as partly a piss-take, it also understood that the diamonds were borrowed, presumably rented, for event and media / communications purposes. Forty years later, "one million dollars" and Emily were reported nationally again, but this time as an art collector selling Jasper Johns’s Three flags to the Whitney Museum of American Art. This time, the artwork replaced her photo accompanying the extensive media coverage.

"Jasper Johns’s groundbreaking work sent shock waves through the art world when it was first shown in the late 1950s...," states the exhibition webpage for Jasper Johns’s retrospective for 2021-22. However, another shock, very little known, concerns the first owner of the artwork, Emily Hall Tremaine (1908-87), and her background related to the iconic artwork, in relation to the American flag in 1940, and the price for which she and Burton Tremaine sold Three flags to the Whitney in 1980.

The sale price of "one million dollars" was certainly primed for wire service report headlines in 1980 for maximum and deep national media penetration, was clearly recognized as such, and reappeared from Emily’s media data bank from 40 years earlier. (See photo and caption, this media / event was reported in several newspapers, partly via wire service articles and photos distributed nationally.) The focus on price in resultant media coverage also is one of many media / communications predecessors of the reported sale of Damien Hirst’s diamond skull in 2007 commanding global headlines via multi-lingual wires service reports.

But given limited, factual contextual information one wonders how deeply aware Emily was of details in her history in 1980, also taking into account her very busy multi-country and location life over four decades. Additionally it seems unclear to what extent she was involved in setting the $1m price in 1980, or if she could practically change it. These details to date have not been fully explored and been put forth, to nail down her intention. Emily appears at times off her game by the early 1970s, so assumptions of intent at this juncture are hazy and cannot be made.

It’s also important to note that, according to a 1991 article in the New York Times, it’s not that they "ran off" with the money (Rief: 7 June 1991, see entry below). Instead it was reported that the money from the sale was "donated to Planned Parenthood, one of their favorite charities..."

Forty years earlier

It was back in 1940 that Emily, around the age of 32, in what would be considered among the most stressful of times in one’s life for many, during a nasty, high-profile and arguably very dangerous divorce fight in Santa Barbara, that Emily passionately declared her loyalty, in deposition, to the American flag. I was struck by it within the layered, dangerous chaos and uncertainty; I presumably am the first to have read her deposition over many decades, that she and her lawyer presumably included for the historical record.

I wonder what is must have been like later in the 1950s to see Johns’s flag artworks. I wonder about her mix of thoughts, about art and life, when selecting Three flags and a White flag for her collection and interiors, viewing the works frequently later. Three flags and the White flag, smaller than the one now at New York’s Metropolitan Museum, become part of her life. Johns made these works, and she lived with them. I wonder what thoughts and memories the works generated. I wonder what it was like realizing the artworks’ growing historical significance, considering its haziness and difference to the literal flag, and also her own life experience in relation to the symbol. (After her passing, in 1988, White flag sold at auction for USD$7m at the first Tremaine Collection auction, selected works, which yes, was also reported by wire services. Louise Lawler also featured the White flag in photoworks, from the bedroom to the auction room.)

I encourage others, with a certain amount of empathy, to imagine her journey with the American flag. Get a copy of the 1940-41 Santa Barbara divorce court record and learn a little about her mystery and dangerous context, and consider the life-long effects. See her mention the American flag. (The facts are not all in, but I suspect it was good Americans and US military intelligence that helped her in c. 1938-40 in her time of need.) Fast-forward into the later 1950s to her seeing the artworks. Imagine living with Three flags and White flag. See Baro’s 1969 Vogue article showing the works, among others, in her interiors, with Three flags right above the couch in her living room in Connecticut. Imagine the conversations with the painting right there. White flag is also shown in her New York bedroom, right above her bed. Imagine the 1980 sale, the media coverage, and letting the artwork go at about age 72 after a long life already, when only she seemed to have known exactly what happened back around 1940, that fading memory, in its layered complexity.

B. Jasper Johns’s Three flags in publications and related documentation


It is essential to note: while the academic debate can focus on Three flags showing flags but it is showing something different ("These are not flags"; Kleiner & Mamiya, 2013, see entry below), this differs when closely looking at the artwork’s non-art world usage as a visual in media. The artwork has been used for example on covers of American history and politics books, perhaps to project "America", "American", "patriotism" but with something else or suggesting a greater complexity. These sources usually don’t discuss the artwork in their books or articles; Three flags is just used as a visual.
